BOONE CREEK RELEASE OF LIABILITY

I acknowledge that I am over 18 years of age and have voluntarily consented to use of the facilities, equipment and property at Boone Creek Angler's Club and Boone Creek Outdoors (collectively, "Boone Creek".)  I understand that Boone Creek is a natural outdoor area.  While upon the premises of Boone Creek, I understand I may be engaged in certain unsupervised outdoor activity ("outdoor activity") including, but not limited to hiking, fishing, camping, sightseeing, canoeing, swimming, and/or driving to and from the Boone Creek.  I further understand that while on the premises of Boone Creek my activity may be unsupervised for prolonged periods of time and that contact with third parties by telephone or otherwise may be difficult or impossible at times.  During certain periods, weather may make access to and from Boone Creek treacherous or impossible.  I understand and agree that weather is unpredictable and it is impossible to predict the onset of such conditions.

I understand and hereby acknowledge that natural outdoor areas can be dangerous, and accompanied by unspecified acts of God. I am voluntarily participating in these activities with the knowledge of the potential dangers involved and agree to accept any and all risks of injury, death or disability associated with same.  I understand outdoor activity can be strenuous and I accept full responsibility for my health while engaging in same. 

I agree to release, indemnify and hold harmless Boone Creek and its owners, agents and employees, for any and all loss or damage I may cause to person or property while occupying outdoor areas and/or engaged in outdoor activity at Boone Creek. 

This includes, but is not limited to, any and all claims for personal injury, disability, death and/or property damage that may arise out of my outdoor activity whether such loss or damage be caused by myself or to others. This shall include any and all claims for personal injury, disability, death and/or property damage that may arise out of my use of equipment or motor vehicles provided for my use at Boone Creek. 

I agree to release, indemnify, and hold harmless Boone Creek and its owners, agents and employees, from any and all liability to me or my property resulting from their own acts of negligence to the fullest extent permitted by law. I agree and understand I have an obligation to keep a look-out for my own safety at all times upon the premises of Boone Creek and Boone Creek does not make any promise or warranty regarding my safety upon its premises. I authorize Boone Creek personnel or employees to administer treatment in the event of an injury to myself or to the minor for whom I am signing.

I acknowledge that I am freely and expressly assuming and accepting any and all risks of property damages, personal injury, disability and/or death as the user of the premises or the equipment supplied to me by Boone Creek. 

While upon the premises of Boone Creek, I shall not engage in any illegal activity. Nor shall I engage in harmful conduct or\willfully or negligently engage in any type of conduct which contributes to or causes injury to person or property.

I agree that if any portion of this agreement is determined to be unenforceable by a court of law, all other parts of the agreement shall remain in full force and effect. I further agree that any claim I may bring against Boone Creek shall be filed in the Commonwealth of Kentucky and I further agree that only the laws of the Commonwealth of Kentucky shall apply in the construction or application of this agreement.

I have read the above paragraphs and fully understand them. I have made no misrepresentation to Boone Creek regarding my name, address, age or other personal information. I agree that there have been no warranties, expressed or implied, which have been made to me beyond the information written on this form. By checking the box associated with this release, I acknowledge that I have read this agreement and release of liability and I understand its contents. I understand that by checking the box associated with this release, I have consented to its terms and conditions and by so doing expressly waive any rights I may have to sue Boone Creek for injuries and damages.

I further certify as parent/guardian with legal responsibility for any minor I bring or permit to visit the premises of Boone Creek, that I consent and agree to his/her release as provided above and for myself, my child, our heirs and assigns the next of kin, I release and agree to indemnify and hold harmless Boone Creek for any and all liability incident to my minor child’s involvement or participation of any activity at Boone Creek even if arising from the negligence of Boone Creek to the fullest extent permitted by law.

While upon the premises of Boone Creek I shall not engage in illegal activity. Nor shall I engage in harmful conduct or willfully or negligently engage in any type of conduct which contributes to or causes injury to person or property.
